Personal Data Protection (KVKK)

This Information Notice has been prepared, in accordance with the Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”) and the relevant secondary legislation, by Bodamya Emlak İnş. Tur. Oto. Gıda Nak. Paz. Tic. İth. ve İhr. Ltd. Şti. (“Kalkan Collection”, “Company”) in its capacity as data controller, in order to inform the natural persons (“Data Subject”) who visit our website (Kalkan Collection), are interested in our villas, submit a reservation request or contact us, about the processing of their personal data.

1. Data Controller

2. Personal Data Processed

Within the scope of your use of our site and your communication with us, the following data categories may be processed:

• Identity and Contact Data: full name, phone number, e-mail address (where shared by you when you fill in the reservation request form or contact us).
• Reservation Request Data: the villa you are interested in, check-in and check-out dates, number of guests, pet preference and the content of your request/message.
• Customer Transaction Data: the villas you view, the content of your requests and conversations, your accommodation preferences.
• Transaction Security and Traffic Data: IP address, browser information, cookie records, on-site navigation data.
• Marketing Data: your interactions with digital advertising and campaigns (e.g. visits coming through social media/advertising platforms).

3. Purposes of Processing Personal Data

• Receiving, assessing reservation requests related to villa rental processes and contacting you,
• Providing information about availability, pricing and accommodation conditions,
• Where your explicit consent exists, sending commercial electronic messages (SMS/e-mail) about new villas and campaigns,
• Carrying out information and communication activities about our services,
• Managing customer relations and satisfaction,
• Operating the site and ensuring its security and continuity,
• Conducting advertising, campaign and promotional activities together with marketing analyses,
• Fulfilling legal obligations and providing information/documents to authorised institutions.

4. Legal Grounds for Processing

Your personal data is processed, within the scope of Articles 5 and 6 of the KVKK, on the legal grounds of the establishment or performance of a contract, the data controller fulfilling its legal obligation, the establishment/exercise/protection of a right, the legitimate interest of the data controller provided that it does not harm the fundamental rights and freedoms of the data subject, and, where required, your explicit consent.

5. Transfer of Personal Data

Your personal data may be transferred, within the scope of obligations arising from legislation, to authorised public institutions and organisations; and, on a limited basis, to the suppliers from whom we receive services (hosting/infrastructure, image storage, communication and advertising service providers), in compliance with Articles 8-9 of the KVKK. Where transfer abroad is required, the conditions stipulated by the KVKK are observed.

6. Method of Collection

Your personal data is collected through the reservation request and contact forms on the website, telephone, WhatsApp, e-mail, social media and advertising platforms, as well as physical/electronic channels, by automated and non-automated methods.

7. Retention Period

Your personal data is retained for the period required by the processing purposes and for the statute of limitations/retention periods stipulated in the relevant legislation; upon the expiry of these periods it is deleted, destroyed or anonymised.

8. Rights of the Data Subject (Article 11 of the KVKK)

As a data subject, you have the right to: learn whether your personal data is processed, request information if it has been processed, learn the purpose of processing and whether it is used in line with that purpose, know the third parties to whom it is transferred at home or abroad, request its correction if it is incomplete/incorrectly processed, request its deletion/destruction where the conditions are met and request that these actions be notified to the third parties to whom the data was transferred, object to a result arising against you as a consequence of analysis solely through automated systems, and request compensation for damage you suffer due to unlawful processing.

9. Application

You may submit your requests regarding your rights to info@kalkancollection.com or in writing to the Company. Your applications are concluded within at most 30 days within the scope of the Communiqué on the Procedures and Principles of Application to the Data Controller.
